Compostable vs Biodegradable vs Recyclable: 3 Label Boundaries Brands Must Not Mix Up — US/EU Compliance

Once a listing on US/EU platforms gets flagged by a compliance team, the consequences range from delisting to product recall. This article clarifies the compliance boundaries, typical misuse, and hard requirements for each of the 3 labels.

In 2024, a client exporting PLA cups contacted me. He had just received a compliance warning from Amazon US because his product detail page said "biodegradable", but PLA cups are not accepted by composting facilities in California and New York. Amazon gave him 14 days to change the wording to "compostable" and provide BPI or TUV certification, otherwise the listing would be taken down. He was confused — in his mind, "biodegradable" and "compostable" meant the same thing.

This is not an isolated case. Last year I helped a client selling PLA straws prepare listing materials for Whole Foods; Whole Foods' compliance team rejected the submission in the first round for the same reason as Amazon — the copy said eco-friendly/biodegradable, but no compostability certification was provided.

The US and EU draw much stricter compliance boundaries for these three labels than China does. Below I will explain clearly what each of the three labels covers, who certifies them, who supervises them, and how to use them without stepping on landmines.

Compostable: the strictest label

The core requirement for compostable is: under industrial composting conditions, the material must break down 90%+ into CO2, water, and biomass within 180 days, with no ecotoxicity. In the EU you need EN 13432; in North America you need ASTM D6400; in Australia you need AS 4736.

Certification is issued by third-party bodies: in the EU it is TUV (Austria) and DIN CERTCO (Germany); in North America it is BPI (Biodegradable Products Institute); in Australia it is ABA (Australian Biodegradable Association). Once you have the certificate you can print the compostability mark on the product — in the EU it is the "seedling" logo plus the "OK Compost" wording; in North America it is the BPI circular mark.

Compliance boundary: compostable is the most demanding of the 3 labels. Products that fail EN 13432 / ASTM D6400 cannot call themselves compostable. PLA generally passes EN 13432, but thickness must be controlled (0.1-0.5mm passes easily; thicker products fail because the degradation cycle is too long).

Biodegradable: the most ambiguous label

The definition of biodegradable is far looser than compostable. In theory any material will biodegrade given enough time — cardboard breaks down in soil in 1-2 years, and PE plastic breaking down in soil in 100+ years still counts as biodegradation. So regulators across jurisdictions are tightening the use of this label.

The EU has ruled since 2022 that packaging claiming to be "biodegradable" without passing EN 13432 will be deemed greenwashing. California has ruled since 2023 that plastic packaging cannot say "biodegradable" unless it has ASTM D6400 or BPI certification. New York followed in 2024. The Chinese national standard GB/T 19277 also has requirements for "biodegradable", but enforcement is weaker than in the US and EU.

Compliance boundary: biodegradable has become a high-risk word in the US and EU. If you do not have compostability certification, it is best not to use the word "biodegradable" on your product detail pages. Switch to neutral terms such as plant-based, bio-based, or renewable — those are much safer.

Recyclable: the most specific label — but also the most abused

The recyclable mark is the most familiar — a triangular Möbius loop made of three arrows. But there are two types of Möbius loop: a solid loop means "recyclable"; a loop with a percentage in the middle means "X% recycled content".

The compliance boundary: recyclable does not mean it will actually be recycled. Both California and the EU require that if you write "recyclable" on your packaging, you must meet one of two conditions: 1) the local municipal recycling system actually accepts this type of material; or 2) the packaging explicitly states "check locally". For example, PLA is not accepted by most US municipal recycling systems (because PLA looks similar to PET but has a different melting point, contaminating the PET recycling stream), so you cannot simply write "recyclable" on PLA packaging.

Another high-risk point is the percentage on the "recyclable" mark. If 30% of your packaging is made of recycled material, you may write "30% PCR"; but you cannot write "Made from recycled materials" unless the proportion exceeds 50%. California has required since 2024 that PCR content disclosure must be truthful, with fines of USD 1,000-10,000 per false disclosure.

4 situations brands most often mix up

Situation 1: using a compostability certification in the wrong market. PLA cups that pass EN 13432 (EU) carry the "OK Compost" mark when listed in the US, but Whole Foods and Amazon require BPI certification (North America) and may refuse the listing. Solution: obtain certification separately for each target market.

Situation 2: listing pages that say both "biodegradable" and "recyclable". California and the EU will treat this as greenwashing, because a material is either biodegradable or recyclable — it is physically impossible to satisfy both at once. The most typical conflict: PLA is compostable but not recyclable (contaminates the PET stream); PE is recyclable but not biodegradable (100+ year degradation cycle).

Situation 3: labels that lack the certification number or issuing body. All legitimate compostability marks must include the issuing body's number (e.g., TUV-123456) and the certificate number. If those numbers are missing from the listing page, Amazon and Shopify will treat it as a false compliance claim.

Situation 4: composite-material packaging using only one label. For example, paper-plastic composite packaging (paper + PE): the outer layer is paper and recyclable, the inner layer is PE and not recyclable. In this case you cannot stick a Möbius loop on the package unless the entire package enters the paper recycling stream (in practice most PE liners get sorted out as trash).

Hard compliance checklist for US/EU listings

Amazon US requirements for food-contact packaging labels: the listing copy must match the actual certification; compostable items must show a BPI or TUV number; recyclable items must have a Möbius loop or PCR percentage; you cannot write biodegradable unless you have ASTM D6400.

Whole Foods requirements for own-brand packaging: all compostable items must have BPI certification; recyclable items must actually be recyclable; the mark must appear on the front of the package, not the back.

EU EPR (Extended Producer Responsibility) compliance: from 2024 onwards, any packaging marked recyclable must comply with EN 13430 or an equivalent national standard; packaging marked compostable must pass EN 13432; biodegradable is essentially banned in the EU.

Practical advice: how brands should write copy without tripping the rules

If you sell PLA products and have passed EN 13432: write "Compostable (EN 13432 certified)" for the EU market, and "Compostable (BPI certified)" for the US market (assuming you have also obtained BPI). Include the certificate number on the listing page.

If you sell recycled-content packaging: write "Made with 30% recycled content" or "30% PCR" on the package; do not write recyclable (unless your package actually enters a recyclable stream).

If you sell ordinary paper boxes: "FSC certified paper" is more accurate than recyclable, because whether a paper box is recycled depends on the local municipal system, not on the packaging itself.

The safest strategy is: quote specific certification numbers in your copy, never broad umbrella terms. Compliance statements such as FSC C123456, EN 13432, and TUV-123456 are the "safe zone" under green-marketing regulation; broad terms like eco-friendly and biodegradable are high-risk territory.

One counterintuitive thing to end on: the more precise your compliance label, the better your marketing result. After I helped that Amazon-delisted client switch to "Compostable (BPI certified)", his listing conversion rate actually went up 12%. The reason is that US and EU consumers are fatigued by broad environmental claims — when they see a specific certification number, they trust you more.

Can one compostability certification cover multiple markets?

No. EN 13432 (EU), ASTM D6400 (North America), and AS 4736 (Australia) are different standard systems, and you must obtain each certification separately. Each certificate is valid for 3-5 years, with annual fees ranging from USD 5,000 to 20,000.

Is PLA compostable or biodegradable?

PLA can pass EN 13432 under industrial composting conditions, so it is compostable. But PLA degrades very slowly in the natural environment (soil, seawater), so you cannot simply write biodegradable. PLA is also not recyclable (mixing it with the PET stream causes contamination).
