What Is FDA Food Contact Material Certification? A Practical Guide to 21 CFR Regulations for U.S. Exports

FDA 21 CFR is not as simple as registration—when exporting food packaging boxes to the U.S., materials, inks, adhesives, and laminations must all undergo indirect food contact testing under 21 CFR Sections 176-178. A single test costs 8,000-15,000 RMB and takes 4-8 weeks. This article uses a real 5-month timeline from an actual customer to clarify the 4 most common pitfalls.

In January 2025, a Suzhou-based client who makes handcrafted cookies sent us a message:

"We got our FDA registration last month, opened our Amazon account, and the shipment was detained by U.S. Customs—the customs office said the packaging materials had not undergone FDA testing."

She sent us a photo of the customs detention notice, which read in English: "Food contact material not in compliance with 21 CFR 176.170."

This is not an isolated case. From 2024 to 2025, we encountered 4 similar cases. The common thread: the client assumed that FDA Facility Registration alone was sufficient, not realizing that the FDA maintains a separate set of compliance requirements for packaging materials themselves—requirements that are a distinct system from FDA Facility Registration, with separate fees and separate documentation.

This article follows the 5-month timeline of the Suzhou client, from placing her order to the successful arrival of her second shipment, to explain the FDA's compliance requirements for food packaging materials in one go.

Month 1: Placing the Order — The Client Doesn't Know That Packaging Also Requires FDA

A client from Suzhou contacted us in early January, looking to produce 5,000 handmade cookie gift boxes, specifications 25×25×8 cm, gray board mounted with coated paper, spot UV, four-color printing plus a custom red logo.

Her exact words when placing the order were: "Our brand sells on Amazon US, and our factory has FDA registration." We asked: "Have the packaging box materials undergone FDA food-contact testing?" She said: "FDA registration is the factory's qualification, so the factory qualification should cover the materials."

This is a common misconception. The FDA's compliance requirements for the food industry consist of two separate systems:

One is FDA Facility Registration — the registration number of the factory as a food production/processing/packaging enterprise. Most legitimate factories have this.

The other is the 21 CFR (Code of Federal Regulations, Title 21) compliance requirements for food-contact materials — which is a different matter. 21 CFR Parts 174-178 set out very specific migration testing requirements for food-contact materials (paper, inks, adhesives, plastics, laminates).

Factory registration ≠ FDA compliance of packaging materials. These two systems are separate accounts.

After we explained this clearly to the Suzhou client, she said: "Then how should we proceed?"

Month 2: First Proofing—The First Pitfall on the Materials Side (Ink)

We immediately advised her to send samples for testing. But her gift box had 4 potential food-contact components:

  • Outer laminated coated paper—in direct contact with the cookie surface
  • Printing ink—UV ink contains photoinitiators and poses a migration risk
  • Spot UV varnish—the UV coating itself is also a potential migration source
  • Laminating adhesive—white latex or starch-based glue, some of which contains formaldehyde

Her original plan was to "test only the outer laminated paper," but we told her that wouldn't work—all 4 components must be tested, or an alternative combination must be selected.

Before sending samples for testing, we had her sign an "FDA Compliance Materials Confirmation," listing all materials, inks, UV coatings, and adhesives along with their suppliers and model numbers. This step is a hard threshold for FDA compliance—if customs later reviews the case and finds you didn't record supplier information, even if the test report passes, the product may still be ruled non-compliant.

She chose TÜV SÜD for testing (one of the most authoritative agencies for FDA testing in China), with single-component testing fees of 8,000-12,000 yuan, totaling over 40,000 yuan for all 4 components. The testing cycle is 4-6 weeks.

The first report came back: the outer laminated paper passed, the UV ink failed—phthalate content was detected at 0.18%, exceeding the 21 CFR 175.300 limit (0.1%).

This was the first pitfall she encountered: the phthalates in UV ink are plasticizers that can migrate to the food surface through contact. The FDA has very strict limits on plasticizer content in food-contact inks. UV inks from most small and medium-sized domestic ink manufacturers have not undergone this testing.

Month 3: First Rework — The Second Pitfall (Adhesive)

We asked her to switch to a different ink supplier (one specializing in food-grade UV ink), and the UV ink passed re-testing.

The second report came back: the box-mounting adhesive failed — formaldehyde migration of 0.45 mg/dm², exceeding the 21 CFR 175.105 limit (0.3 mg/dm²).

This was the second pitfall: the white latex / starch adhesives commonly used by domestic gift box manufacturers generally do not meet FDA food-contact requirements. The FDA requires the adhesive to pass 21 CFR 175.105 testing, with a very low limit.

The solution was to use FDA food-grade adhesive (acrylic-based or EVA-based), which is 30–50% more expensive per unit but can pass the testing.

We re-produced the samples and submitted them for testing. Another 4 weeks gone.

Month 4: Third Test — Third Pitfall (Instruction Leaflet)

The third report showed that the adhesive was compliant. All component tests passed.

However, another issue arose during the review of the product packaging instructions. The original leaflet stated, “This product complies with FDA food-contact standards.” We asked her to use a more specific statement instead.

This is the third pitfall: the FDA does not allow packaging to make arbitrary claims of “compliance with FDA standards”—this constitutes an unauthorized health claim. The correct wording is “Materials comply with 21 CFR 176-178 for indirect food contact use” or a similar qualified statement.

The instructions required three revisions before receiving legal approval.

Month 5: Second Shipment—But There's a Fourth Pitfall (Lamination)

At the end of May, her gift boxes finally arrived. She shipped 1,000 units to the U.S. Amazon warehouse.

Two weeks later, she messaged us again. This time it wasn't bad news—it was a complaint: "Why didn't you tell me earlier that the packaging boxes also need lamination? The U.S. market has different recycling requirements for lamination..."

This is the fourth pitfall, not an FDA compliance pitfall—it's a recycling compliance pitfall: multiple U.S. states (California, Washington, New York, etc.) have recycling restrictions on packaging lamination, and PVC lamination cannot be used for certain packaging categories. She used BOPP lamination, which isn't a big issue; but if PVC lamination had been chosen at that time, U.S. Customs would have rejected the shipment.

FDA compliance and environmental compliance are two separate systems. FDA only governs food safety, not recycling and environmental requirements.

Lessons from 4 Pitfalls in 5 Months

Condensing the Suzhou client's 5-month timeline into 5 actions:

Action 1: Before placing the order, ask the client "which country, market, and application is this for export?" — U.S. FDA, EU EFSA, and Japan JHOSPA standards are completely different; mixing them means rework.

Action 2: List the food-contact component inventory — face paper / liner paper / ink / UV / adhesive / lamination film, evaluate each component individually.

Action 3: Select food-grade inks and adhesives — phthalates, formaldehyde, and heavy metals are the three mandatory checks.

Action 4: Avoid vague "FDA standard" wording in the specification sheet — cite the specific regulatory sections.

Action 5: Lamination and recycling compliance — BOPP is better than PVC, and stay away from the restricted/prohibited lists in California/Washington State.

FDA testing is not a monster, what's expensive is time and rework. The Suzhou client spent over 80,000 yuan on testing fees + over 60,000 yuan on material price differences + over 30,000 yuan on delay losses over 5 months — of which at least 120,000 yuan was rework cost caused by insufficient preparation in the first month.

Is FDA Facility Registration the same as 21 CFR testing?

No. FDA registration is a facility registration number for food/packaging enterprises; 21 CFR testing is the food contact compliance testing for the packaging material itself. Two systems, two fees, two sets of documents. Having an FDA facility registration does not mean the packaging material has passed FDA.

My packaging box does not directly contact food. Do I still need FDA testing?

Yes. 21 CFR also has requirements for 'indirect food contact' (e.g., outer laminated paper of a gift box contacting the surface of cookies, inner liner paper contacting food). If your packaging is fully isolated (aluminum foil independent packaging + independent paper box), the paper box itself is exempt; however, gift box scenarios typically cannot be exempted.

Do small batch orders also require FDA testing?

If only producing small batches to test the market, it is recommended to directly select FDA-compliant food-grade inks and adhesives and skip submission. But once entering the US market in large batches, complete testing must be done—Amazon and customs reviews will trace back.

How long is the validity period of the FDA testing report?

FDA 21 CFR testing reports themselves do not have a clearly defined 'validity period', but supplier changes, formula changes, and regulatory updates will all invalidate the old report. Industry practice is to conduct a review test every 12-24 months. We recommend a random test once a year.

Is FDA testing only for the US market? What about other markets?

Different markets have different compliance systems: EU follows EFSA + Food Contact Regulation 1935/2004/EC, Japan follows JHOSPA + Food Sanitation Law, China follows GB 4806 series. For the same food packaging to be exported to multiple markets, separate testing is required or select materials that have passed multi-country certifications.
